Trellis Volunteer Agreement and Release

In consideration for the willingness of Trellis Horticultural Therapy Alliance (“Trellis”) to accept the individual signing below (“Volunteer”) as a volunteer to engage in work, services and other activities with Trellis on a voluntary, unpaid basis (“Volunteer Work”), and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, Volunteer does freely, voluntarily and without duress execute the following Volunteer Agreement and Release (“Release”) for and on behalf of him or herself and his or her heirs, successors, beneficiaries and assigns:

1. Volunteer’s Participation. Volunteer will perform Volunteer Work on an intermittent schedule determined by mutual agreement of Trellis and Volunteer. Trellis will provide on-going support and direction to Volunteer, as appropriate. In performing Volunteer Work, Volunteer agrees that Volunteer is not an employee or agent of Trellis and is not entitled to any compensation or benefits from Trellis.

2. Conduct of Volunteer. In performing Volunteer Work, Volunteer agrees to comply with Trellis’s rules, regulations and policies in effect during the performance of Volunteer Work and as may be changed from time to time by Trellis. Volunteer also agrees to comply with directions given by Trellis. Volunteer will provide Volunteer Work in a professional manner consistent with the highest standards of ethical and moral conduct. Volunteer warrants and represents that all information that Volunteer has provided to Trellis regarding Volunteer’s background, experience and/or skills is true and accurate, and assumes responsibility for any and all claims, costs, damages, or liabilities that result from the provision of incomplete or inaccurate information.

3. Release. Volunteer releases, forever discharges, indemnifies, and holds harmless Trellis and its directors, officers, employees, volunteers, agents, successors and assigns (collectively the “Released Parties”) from any and all liability, claims, demands and causes of action of whatever kind or nature, either in law or in equity, arising out of or relating to Volunteer Work, including but not limited to any claim for any bodily injury, personal injury, illness (including but not limited to COVID-19), death or property damage that may arise out of, occur during or result from Volunteer Work, regardless of whether caused in whole or in part by an act or omission of a Released Party. Volunteer also understands that, except as otherwise agreed to by a Released Party in writing, the Released Parties do not provide any financial assistance of any kind, including but not limited to medical, health or disability insurance coverage for any volunteer.

4. Assumption of Risk. Volunteer understands that the Volunteer Work may involve inherently dangerous risks, including, but not limited to, physical work such as gardening, digging, planting, lifting, carrying, using tools or equipment and other strenuous activity, and travel to and from locations where Trellis is performing its services. In addition to any other risks posed by doing Volunteer Work, Volunteer understands that, despite any safety precautions being taken by Trellis, by volunteering with Trellis, there is a risk of potential exposure to COVID-19 or any other harmful virus or bacteria, which may result in illness or death. Volunteer hereby expressly and specifically assumes the risk of damage, injury, illness, harm or death in connection with the Volunteer Work.

5. Medical Treatment. Volunteer hereby authorizes representatives of Trellis: (1) to act on Volunteer’s behalf in providing first aid and securing medical treatment for Volunteer in the event of injury or illness to Volunteer; and (2) to act on Volunteer’s behalf in accepting financial responsibility (which will be borne solely by Volunteer) for all first aid and treatment secured for Volunteer. Volunteer understands and agrees that any expense will be Volunteer’s responsibility.

6. Confidentiality. Volunteer agrees to keep confidential and not use for any purpose other than carrying out the Volunteer duties any confidential information obtained by Volunteer at any time, including but not limited to any personal, health or family information of any Trellis program participant or family member of a program participant, any information shared by a program participant in participating in a program, or any personal information of any client, employee, contractor or volunteer of Trellis, or any financial or other business information of Trellis. Volunteer understands that any violation of confidentiality will result in disciplinary action, which may include termination of Volunteer Work or other actions, including legal action, at Trellis’s discretion.

7. Transportation Release. Volunteer releases, forever discharges, indemnifies and hold harmless the Released Parties from any and all liability, loss, costs or expenses sustained or incurred because (a) Volunteer was injured, died or sustained property loss or damage while being transported by any of the Released Parties, or (b) because Volunteer injured another person or damaged the property of another person while being transported by any of the Released Parties.

8. Photographs and other Media. Volunteer grants and conveys to Trellis all right, title and interest in any and all photographic images and video or audio recordings made by or for Trellis during Volunteer Work, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

9. Miscellaneous. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the state of Georgia, and that this Release will be governed by and interpreted in accordance with the laws of the state of Georgia without giving effect to its conflict of laws rules. Volunteer agrees that in the event that any clause or provision of this Release is held to be invalid by any court of competent jurisdiction, the invalidity of that clause or provision will not affect the remaining provisions of this Release, which will continue to be enforceable. Volunteer agrees that the sole and exclusive jurisdiction and venue for litigation between Volunteer and Trellis will be a state or federal court having jurisdiction over Dekalb County, Georgia. Volunteer acknowledges having had an opportunity to read this Agreement in full and an opportunity to ask any questions regarding its contents.
